2017 Terms & Conditions

We ❤ LOVE  a good sale! There's nothing quite like finding something you love for a price you love just as much. To help make the whole process easier for both Aquadiva and our lovely customers we have some Clearance Sale 2016 Terms & Conditions below.

Please remember that these rules only exist to help make everything run smoothly and efficiently. By purchasing from the Sale you automatically agree to these terms. These terms only apply to discounted Sale items, not new stock items purchased at full price.  

    1. Payment & Item Reservation -
      We take payment when your order is submitted to ensure you have completed the process. Your order is then filled once payment has been confirmed. We do this for two reasons - one is to ensure you've actually paid, which goes hand in have with the second reason of making sure your goods are secured in your name. If you do not pay for your items we unfortunately cannot hold stock for you.

    2. Processing Times - 
      Our team does our best to get everything processed and sent ASAP. You can budget 2-5 days for order processing, which does not include shipping time. If there is any reason for significant delay (over 10 working days) we will let you know via email at the first opportunity. Remember, patience and courtesy goes a long way to getting what you want. If you need something FAST be sure to let us know, as choosing express postage does not mean express processing as we fill orders on a first-come, first-served basis to be fair to all customers. 

    3. All sales are FINAL - Please Choose Carefully! 
      We cannot accept returns on sale items purchased for a discounted price due to change of mind, so please measure yourself, choose carefully and double check that you've ordered the right size and style. We also reserve the right to provide a refund at our discretion depending on the circumstances and usually only in relation to a manufacturing fault or defect.

    4. Exchanging an Item + Return/Exchange Fee - 
      You may exchange for anything you like using the credit from an exchanged item. This is to make sure you end up with something that fits and that you're happy with, as of course we want you to be delighted with and able to wear your Aquadiva purchase!

      Please note that all items returned for refund instead of exchange (that have been approved) will incur a 20% handling fee calculated from the order total to cover our time and expenses in packing and processing your order.

    5. Stock Availability -
      Please be aware that Aquadiva does our absolute best to make sure any item displayed on the website is available for purchase, though it does not represent a guarantee. Sometimes errors are made or items go missing and this can be an unfortunate situation for everyone involved. Other times we may have to wait for a stock top-up to be delivered, which may take 1-2 weeks. 

      If you have submitted an order and the item is totally UNAVAILABLE, as in cannot be supplied, you will be contacted ASAP via email and asked what you would like to do - choose something else, remove the item from the order or receive a refund. 

    6. Free Shipping (ALL orders over $150) & Order Safety -
      We are very happy to offer Free Standard Shipping on all orders over $150. Only shipping methods stated as having tracking actually include tracking and so in the event of an order going missing we can only attempt to locate it if you chose to use a service with tracking. If you do not opt for tracking we cannot be held responsible for lost or missing items. 

      Additionally, once an order leaves Aquadiva we have no control over shipping times, delivery or item safety, and so we are removed from all liability for financial loss and any obligation to provide a replacement.

      Having said this we always look after our girls, so we'll do our best to help! If you need it FAST let us know too so we can organise it for you. 

    7. Sale Terms & Conditions Applicability - 
      The Terms & Conditions listed above only apply to sale items sold in the online store that are clearly marked and categorised as discounted sale items. This means our normal terms and conditions will apply to non-sale items.
